1. About us and these terms
These terms apply to recruitment services provided by Wright Resourcing Ltd, a company registered in England and Wales (company number 16596888), with its registered office at Suite A, 82 James Carter Road, Mildenhall, IP28 7DE ("we", "us"), to the business engaging us ("you", "the client"). They form the contract between us, together with the written quote or confirmation we send you. By instructing us to start work, you agree to these terms.
2. Our services
We provide the package or modular services set out in your quote. The packages are:
- Basic: job advert creation, advertising on UK job boards, LinkedIn and social media, forwarding suitable applications, and notifying unsuccessful applicants.
- Enhanced: everything in Basic, plus CV sifting, pre-screening calls, shortlisting and candidate summaries.
- Premium: everything in Enhanced, plus management of the interview process, offers and regrets, and reference checks.
Basic and Enhanced are advertising and screening services. We will use reasonable skill and care, but we cannot guarantee a particular number of applicants or that a suitable candidate will be found or hired.
3. Fees
- Fixed fee packages and modular services: the fee is the fixed amount in your quote, for each role. Prices on our website are starting prices; your quote confirms the actual fee.
- Premium: the fee is 10% of the candidate's annual basic salary for the first year of employment, payable for each candidate you hire through the Premium service.
- Multiple roles: where roles are bundled, the bundled price in your quote applies.
- VAT: VAT will be added to fees where it applies.
4. Invoicing and payment
- Fixed fee packages and modular services are invoiced when you instruct us, unless your quote sets out a Pay As You Go arrangement, in which case the payment schedule in your quote applies.
- Premium fees are invoiced on the candidate's start date.
- Invoices are payable within 14 days of the invoice date.
- We may charge interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Cancellation
You may cancel a fixed fee assignment before any advert has been published and we will refund what you have paid, less any advertising costs already incurred. Once an advert has been published, fixed fees are non-refundable. You may cancel a Premium assignment at any time before an offer is accepted without charge.
6. Your responsibilities
- Give us accurate information about the role, including salary, hours, location and any requirements.
- Make your own hiring decision and satisfy yourself that a candidate is suitable.
- Carry out right to work checks before the candidate starts, and any other checks required by law for the role, such as DBS checks.
- Provide the employment contract and meet all legal obligations as the employer.
7. Candidates and data
You will have access to the candidate applications and information collected for your role, and you may keep and use them for your own recruitment after the assignment ends, in line with data protection law. Each of us is responsible for handling personal data in line with UK GDPR and the Data Protection Act 2018, and only for the purposes of recruitment. See our Privacy Policy.
8. Liability
We are not liable for any loss arising from your decision to hire a candidate, the conduct or performance of a candidate, or information supplied by candidates or referees. Our total liability to you for any assignment is limited to the fees you have paid for that assignment. Nothing in these terms limits liability that cannot be limited by law.
9. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of these terms is found to be unenforceable, the rest remains in effect. Any change to these terms must be agreed in writing.
